The tools that generate an entire application from an invention disclosure are impressive in a demonstration and difficult in practice. Claim scope is the strategic core of a patent: too broad and it is anticipated, too narrow and it is designed around. A model has no view on the client’s competitors, the prosecution history of the field or the commercial embodiment that matters, and the attorney who has to rework a generated claim set saves little.
So we reverse the order. The attorney writes or settles the claims first. The system then drafts the description to support them, in the firm’s own style and from its precedents, and checks the result the way a careful colleague would: every claim term defined or supported, reference numerals consistent with the figures, no stray language that narrows the claims by implication.
