Traditional watch services match on characters and classes, so a report for a busy mark runs to pages of hits that share three letters and nothing else, and the conflict that matters, a phonetic twin in a neighbouring class or a figurative mark that uses the same idea, can be buried in the middle. Opposition windows are short; at the EUIPO it is three months from publication. A report nobody has time to read carefully is worth little.
Comparing marks the way an examiner or a court does, by visual, aural and conceptual similarity and by the relatedness of goods and services, is something modern models do reasonably well, including for image marks. The point is not to decide anything; it is to put the ten candidates that deserve an attorney’s attention at the top, each with a plain explanation of why.
